Before January 1, 2023, if you believed that the work carried out by your contractor did not meet the specifications or had construction defects, you had to go through the court to explain the situation and change the contractor.
If you hired another contractor to rectify the situation, you would lose the warranty of the first contractor on that work.
For contracts concluded since January 1, 2023, you no longer need to go to court to change the contractor if you can demonstrate exceptional circumstances that prove an irreparable breach of trust.
In these exceptional cases, the costs of rectifying the situation will remain the responsibility of the first contractor.
